Childcare in Islamic Families After Divorce: A Study of the Division of Parental Responsibilities Based on Fiqh Al-Usrah

Abstract

This research is based on the reality that divorce in Muslim families often raises issues in childcare, particularly regarding the division of responsibilities between parents after the divorce. From an Islamic perspective, this issue can be resolved by consulting Fiqh al-Usrah, which provides guidance on the rights and obligations of parents towards their children, particularly in the context of divorce. This research aims to analyze how parental responsibilities for childcare are divided after divorce, based on the principles of Fiqh al-Usrah, and how these principles are applied in the daily lives of Muslim families. The method used is a literature review with a normative approach, analyzing classical and contemporary fiqh texts on divorce, child custody, and the division of parental responsibilities. In addition, this research also explores the application of these principles through case studies in society. The results show that Fiqh al-Usrah provides a clear legal basis for the division of parental responsibilities, with child custody usually given to the mother, while the father remains obligated to provide child support and education. This research also found variations in the application of this principle in society, depending on local interpretations of Islamic law and existing social practices.
