The Effectiveness of the Consumer Protection Law in Providing Legal Certainty and the View of Islamic Law on Consumers of Dangerous Cosmetics: A Normative Evaluation

Cosmetics have become a necessity for modern society, and their growth has experienced significant increases. However, currently, many cosmetics contain hazardous materials that require legal action. On the other hand, is the Consumer Protection Law, which provides legal certainty and Islamic legal perspectives for society, effective? Because many problems still occur to this day. Transformation is needed, both from its legal basis that needs to be adjusted, supervision and law enforcement by stakeholders, and massive education for consumers and producers. This study aims to analyze the effectiveness of the Consumer Protection Law, identify obstacles in its implementation, and what recommendations need to be made to improve consumer protection, especially for cosmetics consumers. This research is normative juridical legal research, which uses a legislative and conceptual approach, with qualitative analysis techniques employing systematic, grammatical, and teleological interpretation methods on relevant legal norms. The conceptual approach examines the doctrines and principles of Islamic law, especially maqāṣid al-sharī‘ah, as well as the values of ḥifẓ al-nafs and ḥifẓ al-māl. Qualitative analysis using descriptive-analytical methods to describe the effectiveness of UUPK and Islamic law in protecting cosmetics consumers, then evaluated normatively to find the ideal reformulation.
