Medicolegal Aspects and Legal Implications and Islamic Legal Perspectives on the Use of Stem Cells in the Health Sector in Indonesia

This study aims to analyze the medicolegal aspects, legal implications, and Islamic law perspectives regarding the use of stem cell therapy in healthcare in Indonesia. The key concepts and definitions utilized include stem cell therapy, medicolegal frameworks, therapeutic relationships, legal protection, and maqashid syariah. A normative-juridical research method was employed, incorporating statutory, conceptual, comparative, and Islamic legal approaches supported by primary and secondary legal materials as well as contemporary international bioethical literature. The object or scope of the research focuses on the national health regulatory system following Law Number 17 of 2023 concerning Health and its synchronization with medical ethics principles and MUI fatwas. The main findings indicate that national regulations still present implementational challenges concerning cell product quality standards, the prevention of premature commercialization, and the fulfillment of patient information rights. The challenges or constraints of the research include the dynamics of biotechnology regulations moving faster than positive legal norms, alongside limited doctrinal comparative literature comprehensively integrating Islamic law. Recommendations and practical implications derived from this study highlight the necessity of strengthening structural supervision, establishing medicolegal standardization, and reforming patient protection to ensure biomedical innovations align with principles of justice and safety.
