Evaluation of the Child Support Process in the Criminal System at the Class II Special Child Development Institution in Bandung

This study aims to evaluate the legal protection process for children within Indonesia's juvenile sentencing system, emphasizing the application of child protection principles and the concept of restorative justice. From a normative standpoint, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA) establishes protection mechanisms through diversion and non-repressive approaches. However, research findings indicate that the application of these principles faces various obstacles, including limited understanding among law enforcement officials, a lack of supporting facilities—such as Correctional Centers and Special Development Institutions for Children—and a legal culture that tends to prioritize punitive measures. An analysis based on legal protection theory reveals that the existing system does not yet fully guarantee legal certainty, utility, and justice for children. Meanwhile, the concept of restorative justice offers a more humane alternative by prioritizing rehabilitation and shared responsibility among the offender, the victim, and the community, although its implementation remains suboptimal. Thus, it can be concluded that Indonesia's juvenile sentencing system requires regulatory strengthening, capacity building for officials, and multi-stakeholder collaboration to ensure that child protection principles are genuinely realized in practice.
