Analisis Validitas Hukum Sumpah Li‘an dan Tes DNA dalam Pembuktian Pengingkaran Anak

Deoxyribonucleic Acid (DNA) testing has been used as an alternative source of evidence in disputes over denial of paternity, in addition to the li’an oath stipulated in Islamic law. However, the legal basis for the use of DNA testing has not been explicitly regulated in Indonesian legislation. This study aims to analyze the legal validity of oaths of allegiance and DNA testing in the context of proving denial of paternity according to positive law and Islamic law in Indonesia. The method used is normative (doctrinal) legal research with a sociological juridical approach. The data sources for this study come from regulations related to li’an oath and DNA testing, as well as five court cases related to denial of paternity. The results show that li’an oath have stronger legitimacy under both Islamic law and positive law, although in practice, courts often consider DNA test results more for the sake of protecting children's rights, empirical justice, and ensuring the child's parentage status. This finding indicates a tension between the principle of procedural justice and the implementation of the best interests of the child.
