Pharmacy practice is a crucial aspect of the healthcare system, strictly regulated by Law No. 17 of 2023 concerning Health and Government Regulation No. 28 of 2024. However, the practice of dispensing medication by non-pharmacy personnel is still frequently encountered in Community Health Centers (Pustu) and Village Health Polyclinics (PKD), raising legal certainty issues and potential risks to patient safety. This study aims to analyze the compliance of this practice with the positive legal framework in Indonesia, examine its legal implications, and formulate policy recommendations to address the distribution of pharmaceutical personnel. The research method used is normative juridical research with a descriptive-analytical approach through a review of legislation, academic literature, and empirical data related to pharmaceutical service practices in primary healthcare facilities. The results show a significant gap between legal norms and practice in the field, primarily due to the limited availability of pharmaceutical personnel in remote areas. This condition has implications for potential legal violations in the criminal, civil, and administrative spheres, as well as increasing the risk of medication errors and irrational drug use. This study concludes the need for a more equitable distribution policy for pharmaceutical personnel, strengthening transitional regulations, and integrating digital pharmaceutical technology to bridge the gap between legal norms and healthcare practices in the community.
