Abstract

Nurses working in primary healthcare facilities face a high risk of occupational accidents and occupational diseases. These risks not only impact the nurses' physical and mental health but can also affect their professional responsibilities and legal standing. In this context, occupational health and safety (OHS) programs play a strategic role, not merely as a technical effort to control workplace hazards but also as an instrument of legal protection for nursing staff in carrying out their duties. This study aims to assess the effectiveness of the OHS program implementation as a form of legal protection for nurses at the Tanjung Enim Community Health Center, referring to Minister of Health Regulation Number 52 of 2018. The method used is a normative-empirical legal approach, which combines analysis of statutory provisions with empirical findings in the field. Empirical data were obtained through documentation studies and in-depth interviews with three nurses and the Head of the Community Health Center. The research analysis is based on the theory of legal effectiveness and legal protection theory to assess the conformity between norms and practices. The research results indicate that preventive legal protection measures are available, including the provision of personal protective equipment (PPE), the implementation of standard operating procedures (SOPs), the implementation of occupational health and safety (K3) training, and regular health checks. However, their implementation has not been consistent and optimal. Meanwhile, repressive legal protection measures have been regulated, but the reporting and documentation mechanisms for work-related incidents still lack clear and systematic standards. Therefore, the implementation of the K3 program at the Tanjung Enim Community Health Center is considered ineffective in ensuring legal certainty and providing a sense of security for nurses in carrying out their profession.
