"Fit-to-work" assessments serve as a vital instrument for worker protection; however, they are not yet explicitly addressed by Indonesian regulations. Neither the Manpower Law nor the Government Regulation on Occupational Health specifies who is authorized to determine an individual's fitness for work—they merely mandate health examinations. Meanwhile, the Indonesian Medical Council Regulation (Perkonsil) No. 90 of 2020 asserts that this competency lies with Occupational Medicine Specialists, though its binding authority is limited to the medical profession itself. This study employs a normative-juridical method—analyzing relevant regulations, professional standards, and court rulings—to examine the legal aspects, competencies, and risks of legal disputes concerning fitness for work. The findings reveal a legal vacuum, an overlap in authority among general practitioners, other medical specialists, and Occupational Medicine Specialists, as well as the emergence of disputes within the Industrial Relations Court. Consequently, it can be concluded that the issue of fitness for work remains in a legal "gray area." There is a need for cross-sectoral regulatory synchronization—specifically through the Ministry of Manpower and the Ministry of Health—to explicitly define fitness-to-work assessments and grant primary authority to Occupational Medicine Specialists. This would ensure legal certainty, professional legitimacy, and the protection of workers.
