Abstract

Abstract

The rapid growth of the creative industry should ideally be followed by industrial development, one of which is freight forwarding/courier services. One of the factors driving this industry's rapid development is the development of online trading system. PT Tiki Jalur Nugraha Ekakurir (JNE), which is engaged in this courier services, plays an important role in the new trading system to deliver the merchandise that goods reach consumers. However, does the Islamic economic law allow to invest in this kind of service? A qualitative approach with descriptive methods is used to analyze the problems. Investment in freight forwarding services at PT. JNE has fulfilled the three elements of wakalah which are wakalah bil ujrah, the object used as wakalah is in the form of is administrative activities services, and the agreement documents have been stated the rights and obligations of the two parties. It can be stated that the investment in PT. JNE complies the Islamic economic law.

Abstrak

Pesatnya pertumbuhan industri kreatif idealnya diikuti dengan perkembang­an industri, salah satunya industri industri jasa pengiriman atau jasa ekspedisi/kurir. Salah satu faktor yang mendorong pesatnya industri ini adalah perkembangan perdagangan dengan sistem jual beli online. PT Tiki Jalur Nugraha Ekakurir (JNE) yang bergerak dalam perusahaan jasa ekpedisi/pengiriman ikut berperan dalam sistem jual beli online agar barang sampai ke tangan konsumen. Namun, bagaimana tinjauan hukum ekonomi syariah tersebut apakah dibolehkan investasi di bidang tersebut? Pendekatan kualitatif dengan metode deskriptif digunakan untuk meng­analisis permasalahan tersebut. Investasi pada jasa pengiriman barang di PT. JNE telah meme­nuhi ketiga unsur akad wakalah yaitu akad wakalah bil ujrah, objek yang dijadikan wakalah adalah berupa jasa yang ber­gerak dalam kegiatan administrasi, dan dalam dokumen perjanjian telah dicantum­kan mengenai hak dan kewajiban diantara kedua belah pihak. Dapat dinyatakan bahwa investasi pada PT. JNE  memenuhi ketentuan hukum ekonomi syariah.
