Abstract


Artikel ini menganalisis pendekatan penggunaan prinsip hukum Islam dalam penyelesaian sengketa bisnis di Indonesia. Prinsip-prinsip hukum Islam, yang meliputi akad, adil, dan muamalah, memiliki potensi untuk memberikan landasan yang kuat bagi penyelesaian sengketa bisnis yang berkeadilan dan beretika. Melalui analisis praktik yang ada, artikel ini menggambarkan bagaimana prinsip-prinsip hukum Islam telah diterapkan dalam penyelesaian sengketa bisnis di Indonesia dan dampaknya terhadap proses penyelesaian sengketa. Kemudian meninjau prospek pengembangan penyelesaian masalah bisnis berbasis prinsip hukum Islam di Indonesia. Dengan mempertimbangkan faktor-faktor hukum, budaya, dan ekonomi, penulis mengidentifikasi peluang dan tantangan yang dihadapi dalam mendorong penerapan lebih lanjut prinsip hukum Islam dalam penyelesaian masalah bisnis. Implikasi dari penerapan prinsip-prinsip hukum Islam dalam konteks hukum bisnis Indonesia juga dianalisis, termasuk potensi kontribusi terhadap pembentukan sistem hukum yang inklusif dan berkeadilan. Melalui kajian ini, diharapkan dapat memberikan wawasan yang lebih dalam tentang bagaimana prinsip hukum Islam dapat diterapkan dalam penyelesaian sengketa bisnis di Indonesia, serta potensi dampaknya terhadap efektivitas dan integritas sistem hukum bisnis di negara ini.
