Maqāṣid Al-Sharīʿah and the Digital Transformation of Islamic Law: A Normative and Ethical Framework for Addressing Global Digital Challenges

Digital transformation presents new challenges for Islamic law, ranging from personal data protection, artificial intelligence (AI), and the digital economy to changes in Islamic family law relationships and practices. The developments require a legal framework oriented toward formal validity, and can assess the goals, risks, impacts, and distribution of benefits in the digital ecosystem. Therefore, this study aimed to reconstruct maqāṣid al-sharīʿah as a normative and ethical framework to address the challenges of digital transformation and to formulate principles applicable to developing contemporary Islamic law. The study adopted a qualitative approach, using literature review methods and normative-conceptual analysis of classical and contemporary maqāṣid literature, Islamic legal thought, and the development of digital regulations and related issues. The results showed that maqāṣid al-sharīʿah developed through four principles: iʿtibār al-maʿnā lā al-mabnā (orientation to the substance of sharia goals), extending maqāṣid protection to the digital space, risk proportionality (tanāsub al-ḍarar), and the sustainability of collective benefits (istidāmah al-maṣlaḥah al-ʿāmmah). These four principles were operationalised through multi-actor accountability, normative traceability, and empirical verification. The frameworks provided a conceptual basis for renewing ijtihad and fatwas on data protection, AI governance, the digital economy, and Islamic family law in ways that were responsive, proportionate, and equitable.
