Institutionalising Ḥifẓ al-Bī’ah as Maqāṣid al-Sharī‘ah in Environmental Governance

This study aimed to propose the institutionalisation of ḥifẓ al-bīʾah (environmental protection) as a contemporary objective within the framework of maqāṣid al-sharīʿah, advancing environmental governance in Indonesia. The results showed that ecological responsibility was intrinsic to Islamic normative teachings based on the theological principles of tawḥīd (divine unity), khilāfah (vicegerency), amānah (trust), and mizān (balance). The contribution of Islamic environmental ethics to embedding ecological values within Indonesian socio-legal infrastructure was examined using a qualitative normative method grounded in Qur’anic exegesis, classical and contemporary legal scholarship, and institutional documents. A shift from normative values toward a framework was advocated for legislation and policymaking. The values addressed climate change, ecological injustice, and sustainable development through interdisciplinary engagement. The process of institutionalising the principles of ḥifẓ al-bīʾah in maqāṣid al-sharīʿah promoted more substantive Islamic values in wider community life, while adhering to democratic principles in making public decisions.
