This study evaluates the implementation of the principle of constitutional supremacy as the main pillar of the rule of law in post-Reform Indonesia. Although Article 1 paragraph (3) of the 1945 Constitution mandates a state based on law, constitutional practice remains marked by a constitutional gap and disregard for Constitutional Court decisions (constitutional disobedience). This evaluative normative (doctrinal) legal research combines statutory, conceptual, and case approaches. Grounded in the rule of law theories of A.V. Dicey, Friedrich Hayek, Lon L. Fuller, and Jimly Asshiddiqie's Pancasila rechtsstaat, this analysis focuses on the legal reasoning in Constitutional Court decisions concerning the Job Creation Law and the revision of the KPK Law. The results show that constitutional supremacy has not been effectively implemented due to the dominance of pragmatic-transactional legal politics, legislative elitism, and the lack of meaningful public participation. The gap between law in books and law in action reflects the weakening compliance of lawmakers. As a solution, this study recommends an integrated strengthening model through three pillars: institutional (monitoring the execution of Constitutional Court decisions and regulatory harmonization), procedural (meaningful participation and constitutional preview), and cultural (constitutional education and the ethics of state administrators).
